Last updated October 30, 2026. Meta has said it plans to appeal and asked the court to pause collection while it does, and the court still has to issue orders on how the fund is run. Timing and details below may change.

New Mexico didn't join the multistate Meta settlement. It took its own case to trial, and in August 2026 a state court ordered Meta to pay about $942 million and change how Facebook and Instagram protect children [1][2].

What the New Mexico judgment includes

  • $375 million civil penalty.
  • A $567 million abatement fund, to be spent over about five years [1][2][3].
  • $33 million for "Awareness and Prevention" within the fund. According to the judgment, it covers youth internet-safety training, media campaigns, school-based education and pediatrician toolkits [2][4].
  • How the rest of the fund is split: $420 million for treatment, $90 million for screening and assessment, $15 million for referral and coordination, and $9 million for evaluation [5].
  • A Meta-funded statewide awareness campaign. The judgment also requires Meta to fund a statewide public awareness and education campaign [2].

When will the money be available?

It's not certain yet. In August 2026, Meta asked the court to let it post a $1.8 billion bond to pause collection while an expected appeal is pending. New Mexico's Department of Justice did not oppose the request [5]. Under the ruling, the fund's five-year spending window is paused during an appeal if Meta posts that bond [5]. Treat any New Mexico campaign timeline as dependent on the appeal.

Who runs it?

The abatement fund is administered under the court's supervision. The court said it will issue separate orders on fund administration and drawdowns [2]. As of October 30, 2026, we haven't seen those orders, so it isn't yet public which agency or administrator will manage the awareness money or how it will be procured.

Reaching New Mexico families

Frequently asked questions

01

How much does Meta owe New Mexico?

About $942 million under the August 2026 state court judgment: a $375 million civil penalty and a $567 million abatement fund.

02

How much of New Mexico's Meta money is for awareness campaigns?

The judgment allocates $33 million of the abatement fund to awareness and prevention, including media campaigns, school education and pediatrician toolkits. It also requires Meta to fund a statewide public awareness campaign.

03

No. New Mexico pursued its own case and won its own judgment.

04

Who will manage New Mexico's abatement fund?

The court said it will issue separate orders on administration and drawdowns. Those details weren't public as of October 30, 2026. The Santa Fe New Mexican reported that the $567 million would likely be deposited in the state Department of Justice's Consumer Settlement Fund, and that lawmakers could set up a dedicated trust fund, as they did for the tobacco and opioid settlements.

Yes, possibly. Meta has said it plans to appeal and asked to post a $1.8 billion bond to pause collection while the appeal is pending. The five-year spending window pauses during an appeal if Meta posts the bond.
